A dispute between the flight attendant and the passenger over who should be responsible for clearing the vomit ended with the woman suing Frontier Airlines.
Almost three years later the lawsuit was settled.
In 2019, Rosetta Sweeney of Durham, North Carolina, filed a lawsuit against Frontier Airlines after she and her 14-year-old daughter boarded a flight returning to Raleigh from Las Vegas, authorities said.
The woman’s lawyer and Frontier Airlines did not immediately respond to a request for comment from McClatchy News on May 2.
On April 19, 2019, the family boarded a return flight home. Once on board, Suni said her daughter had no place to put her hand luggage under the seat in front of her, so she tried to place it in the upper compartment, according to court documents obtained by McClatchy News.
When she carried the bag to the ward, the teen told her mother she “smelled and smelled the liquid on her hands” and “thought she was vomiting on a stranger’s hands”, adding that the floor, seat pocket and backrest tray were closed. in vomiting, court documents say.
The mother notified the flight attendant, who returned with Clorox wipes and gloves, so the woman could clean their seats, saying it was “not her job” to clean up. When Sweeney refused to clear the area, the flight attendant reportedly told her that, according to authorities, she was “not flying Flight 2066 no matter what.”
After the mother decided to relocate to two vacant seats, a Frontier employee asked the family to leave the plane, court documents said.
Sweeney repeatedly objected to the departure until officers asked all other passengers to get off the plane “because of one rude passenger” on the plane’s intercom, authorities said.
After the woman finally got off the plane, court documents allege that she was handcuffed and arrested for the violation, and her daughter was temporarily taken into custody by the Nevada State Child Protection Service.
The court documents included a statement from Frontier Airlines a few days after the incident, which said that “the flight attendants apologized and immediately invited the mother and her teenage daughter to go to both ends of the plane so that the seat could be cleaned.”
A statement from Frontier said that “the mother was unhappy with the reaction and became unhappy”, and as a result “the flight attendants determined that the mother and daughter should be dropped off and placed on another flight”.
Sweeney said her family “suffered severe mental and emotional distress” and that their reputation was “tarnished” after the incident, according to court documents.
The woman filed a complaint on August 8, 2019, demanding $ 55 million in damages, court documents show. The woman sued the airline for libel, negligence, gross negligence, intentional infliction of mental disorder and negligent infliction of mental disorder.
In January 2022, the airline and the family reached an agreement, showing court documents, but did not specify the amount.
